1. Acceptance of Terms

By checking the consent checkbox and using RentDraft (rentdraft.in), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. This is a binding clickwrap agreement.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into contracts under Indian law to use RentDraft. By using the service, you represent and warrant that you meet these requirements.

3. Service Description

RentDraft is a document automation tool that generates rent agreement templates based on user-provided inputs. RentDraft is NOT a law firm, legal service provider, or substitute for professional legal advice. No attorney-client relationship is created by using RentDraft.

4. Not Legal Advice

Documents generated by RentDraft are templates for informational purposes only. They do not constitute legal advice, and RentDraft does not guarantee the legal validity or enforceability of any generated document. Users should consult a qualified legal professional before executing any agreement. RentDraft recommends independent legal review before execution.

5. AI-Generated Content Disclosure

RentDraft uses artificial intelligence (AI) to generate agreement content, including custom clauses. AI-generated content may contain errors, inaccuracies, or omissions. You are solely responsible for reviewing all generated content before use. RentDraft does not guarantee the accuracy, completeness, or legal correctness of AI-generated text.

6. User Responsibilities

• Providing accurate and truthful information
• Reviewing all generated documents carefully before execution
• Ensuring compliance with applicable state and local laws
• Completing registration, stamping, and notarization as required by law
• Not using the service for fraudulent, illegal, or unconscionable agreements
• Confirming you have the right to provide the other party's personal information
• Printing the agreement on appropriate stamp paper as required by your state

7. Acceptable Use

You agree not to use RentDraft to:

• Generate agreements containing discriminatory, illegal, or unconscionable terms
• Create fraudulent agreements or misrepresent facts
• Include clauses that waive statutory tenant or landlord rights
• Attempt to reverse-engineer, scrape, or abuse the service
• Overwhelm our servers with automated or excessive requests

8. Privacy & Data

We collect minimal data necessary to provide the service. Aadhaar and PAN numbers are processed entirely on the client-side and never transmitted to or stored on our servers. Your agreement details are sent to our AI provider for document generation. See our Privacy Policy for full details including third-party data processors and cross-border transfers.

9. Payments & Refunds

Payments are processed through Razorpay. All prices displayed are in Indian Rupees (INR). See our Refund Policy for details on refunds and cancellations.

10. Intellectual Property

RentDraft's branding, design, code, AI prompts, and original content are owned by RentDraft. Generated documents are provided for the user's personal use in connection with their rental agreement needs.

11. Limitation of Liability

To the maximum extent permitted by law, RentDraft's total liability for any claim arising from your use of the service shall not exceed the amount you paid for the specific transaction giving rise to the claim. RentDraft shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use generated documents.

12. Indemnification

You agree to indemnify and hold harmless RentDraft, its founders, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the service; (b) your breach of these Terms; (c) any dispute arising from agreements generated using RentDraft; or (d) your provision of inaccurate information.

13. No Party to Agreements

RentDraft is not a party to any agreement generated using the platform. RentDraft has no obligation to mediate, arbitrate, or otherwise resolve any dispute between landlords and tenants.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or the use of RentDraft shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Lucknow, Uttar Pradesh. The language of arbitration shall be English.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, the courts of Lucknow, Uttar Pradesh shall have exclusive jurisdiction.

16. Modifications

We may update these terms at any time. Material changes will be communicated via the website. Continued use after changes constitutes acceptance of updated terms.

In accordance with the Information Technology Act, 2000 and IT (Intermediary Guidelines) Rules, 2021:
